Initially begun to address a labor shortage, the H1-B visa program has expanded. The numbers of H1-B visas granted each year are strictly limited and there is great competition for the number of available visas. If an H1-B visa application is filled out and submitted incorrectly, it must be resubmitted and properly completed. Your resubmission is placed at the end of the line, and given the limited number of visas allocated, you may be too far back in line to obtain a visa for the current year.

H1-B Visa Eligibility and Requirements

Individuals sponsored for an H1-B visa must possess

  • A bachelor's or higher degree or its U.S. equivalent

These must directly enable the employee to perform the duties of the H1-B visa sponsored position. The wage offered to the H1-B sponsored individual must minimally be the current wage, or the actual wage paid to other workers similarly employed, whichever is higher.

Employees who are sponsored to work in the U.S. on an H1-B work visa are primarily allowed to work in the U.S. for up to three years, though this time may be extended to up to six years. Time is extended past six years in one-year increments if a labor certification is pending and meets certain criteria.
